Roe was based on the court's inability to determine when life begins. In the time since Roe, it has become glaringly obvious, through the practice of in vitro fertilization, that life begins at conception. If the court had been wiser, they would have erred on the side of caution and made abortion illegal except in the case where the pregnancy threatens the life of the mother. In which case the decision lies with the mother - because it is her life that is in danger.
