I think she disqualified herself the moment she accepted the nomination under those qualifiers. To do so marked her as lacking the character necessary to sit on the SCOTUS. Were we a nation of better character, such a person could not have been in a position to have been nominated. In an ideal America, every woman of color would have stood up and told Mr. biden that they would refuse any nomination under those qualifiers - that it would taint their tenure to serve having been nominated like that - which it will. But then, in an ideal America, someone who would attach such qualifiers to the nomination wouldn't be occupying the Oval Office.
